Terms of Use

These Terms of Use (the "Terms") govern the use of "English Thinking Gym" (the "Service"). Users of the Service (the "User") agree to these Terms when using the Service.

1. Application

1. These Terms apply to all aspects of the provision and use of the Service.
2. Any separate guidelines or policies for the Service form part of these Terms.

2. Service Description

1. The Service is a 7-day cycle case-study style training web application designed to build decision-making and writing skills in English.
2. Features and content may be changed, added, suspended, or discontinued at our discretion.

3. Account Registration and Management

1. Users create an account via Supabase Auth to use the Service.
2. Users must not register false or inaccurate information.
3. Users are responsible for managing their account information (email, password, etc.). We are not liable for unauthorized use by third parties.

4. Fees and Payment

1. The Service is provided as a monthly subscription after any free trial period (pricing and currency are shown in the plan information).
2. Payments are processed through Stripe. Users agree to Stripe's terms of service.

5. Prohibited Conduct

Users must not:

1. Violate laws or public order and morals
2. Engage in or facilitate criminal activity
3. Infringe our or third parties' intellectual property, portrait rights, privacy, or other rights
4. Use or attempt to use another user's account without authorization
5. Place excessive load on our servers or network
6. Interfere with the operation or provision of the Service
7. Copy, redistribute, or commercially use Service content without permission
8. Engage in any other conduct we deem inappropriate

6. Intellectual Property

1. All intellectual property rights in the Service belong to us or our licensors.
2. Users may not use content (text, scenarios, feedback, etc.) beyond personal learning purposes.
3. Users retain copyright in text and notes they input. We may use such content in anonymized form for Service provision and improvement, including analysis and statistics.

7. Service Changes, Suspension, and Termination

1. We may change, temporarily suspend, or terminate the Service without prior notice when:
   • System maintenance or emergency response is required
   • Force majeure (natural disasters, power outages, communication failures, etc.) makes provision difficult
   • We otherwise deem it necessary
2. We are not liable for any damage to users or third parties arising from such changes, suspension, or termination.

8. No Warranty

1. The Service is provided "as is." We do not warrant that the Service is free from defects in fact or law (including safety, reliability, accuracy, completeness, effectiveness, fitness for purpose, or security).
2. AI feedback and suggestions are for learning support only. We do not warrant their accuracy, completeness, or usefulness.

9. Limitation of Liability

1. We are not liable for any damage arising from or in connection with use or inability to use the Service, except in cases of our willful misconduct or gross negligence.
2. Even when we are liable, our liability is limited to the amount paid by the user for the Service in the month in which the damage occurred.

10. Term and Withdrawal

1. Users may withdraw at any time using the account deletion feature.
2. We may suspend or delete accounts without prior notice if users violate these Terms.

11. Changes to the Terms

1. We may change these Terms at any time without prior notice.
2. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

1. These Terms are governed by the laws of Japan, based on the location of our principal place of business.
2. Any dispute arising from the Service shall be subject to the exclusive jurisdiction of the court with jurisdiction over our principal place of business as the court of first instance.
